Privacy Policy

This statement of our privacy policies (the “Privacy Statement”) sets forth a commitment and description of policies and practices related to the collection and use of your personal data by Ready Pac Produce, Inc. and its successors, parents, subsidiaries, affiliates, and related companies or other companies under a common control that we may have now or in the future operate (“Ready Pac,” “we,” “our,” or “us”). The term “Site” includes the website at www.readypac.com and all sub-components thereof, such as a landing site when you click on a Ready Pac product QR code. By accessing the Site and providing us with personal information, you agree to be bound by this Privacy Statement. If you do not agree with any term in this Privacy Statement, please do not provide us your personal information or use the Site.

Please note: The laws and regulations in different countries, States, Commonwealths and Districts, may impose different (and even conflicting) requirements on Internet activity and data protection/privacy depending upon where the consumer resides. Ready Pac is based in the State of California, and the servers that make the Site available worldwide are located in the United States. All matters relating to the Site are governed by the laws of the State of California, without reference to its conflicts of law rules that could result in the application of the laws of another jurisdiction.

Your U.S. State Privacy Rights

Depending on the jurisdiction in which you live, you may have the following consumer rights, subject to exceptions allowed by law, including under the California Consumer Privacy Act of 2018 (“CCPA”), the California Privacy Rights Act of 2020 (“CPRA”), the Colorado Privacy Act, the Connecticut Personal Data Privacy and Online Monitoring Act, the Iowa Consumer Data Protection Act, the Utah Consumer Privacy Act, and the Virginia Consumer Data Protection Act:

Transparency: Businesses that collect personal information subject to the above listed laws are required to provide you with notice regarding the categories of personal information to be collected, the purposes for which the categories of personal information are collected or used, whether that information is sold or shared, and the length of time we intend to retain each category of personal information, or if that is not possible, the criteria used to determine that period, among other information.

Know and access the categories and specific pieces of personal information Ready Pac has collected about you, the categories of sources from which the personal information is collected, the business purpose for collecting the personal information, and the categories of third parties with whom Ready Pac shares personal information.

Correct inaccurate or obsolete personal information that Ready Pac may maintain.

Delete personal information under certain circumstances.

Not to be discriminated against on the basis of your exercising any of your rights afforded by state law.

Limit the use, disclosure, or processing of sensitive personal information. Ready Pac does not collect or use sensitive personal information in any manner that requires the right to limit because

Ready Pac does not collect any Sensitive personal information, and accordingly, Ready Pac does not sell or share Sensitive personal information.

Opt out of the sale, certain processing, or sharing of personal information. Ready Pac does not sell or share your personal information, except as set forth below in “Information Sharing and Disclosure.”

Because Ready Pac is based in the State of California, we also highlight below specific data collection rights for California residents. If you reside in any other State, Commonwealth or District within the United State of America, that provides additional data collection rights, you can assert your rights by contacting us at webmaster@readypac.com. Colorado, Connecticut, and Virginia residents may appeal the denial of a request made by emailing us at the above email address, and we will respond within the legally required time period, including a written explanation of the results of your appeal.

Rights For California Residents

If you reside in California, you have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months, including:

The categories of personal information we have collected about you.

The categories of sources for the personal information we collected about you.

Our business or commercial purpose for collecting that personal information.

The categories of third parties with whom we share that personal information.

The specific pieces of personal information we collected about you.

If we disclosed your personal information for a business purpose, identifying the personal information categories that each category of recipient obtained.

You also have the right to request that we delete any personal information that we have collected from or about you. There are some reasons we will not be able to fully address your request, such as if we need to complete a transaction for you, to detect and protect against fraudulent and illegal activity, to exercise our rights, for our internal purposes, or to comply with a legal obligation.

You have the right to direct us to not sell or share your personal information. We do not, however, sell or share your personal information with third parties, except as set forth below in “Information Sharing and Disclosure.”

We will not discriminate against you because you exercised your rights under this Privacy Statement. To exercise your rights, please contact us at webmaster@readypac.com.

We will first acknowledge receipt of your request within 10 business days and then provide a substantive response within 45 calendar days after its receipt. If we require more time (up to 90 days, or the permitted time frame), we will inform you of the reason and extension period in writing.

Only you or your authorized agent may make a consumer request related to your personal information. You may designate an authorized agent to submit your request on your behalf, but only if the authorized agent has your written permission to do so and you have taken steps to verify your identity directly with us.

How We Verify Your Request: We will only use the personal information provided in the context of your request to verify your identity or the authority of your authorized agent to make the request. Depending on how you interact with us, we may require that you provide at least two pieces of personal information, such as your name, email address, or other information that we already have in our possession. We will verify your request by comparing the information you provide to information already in our possession to minimize the risk of fraud.

There are exceptions to our obligation to comply with the CCPA/CPRA, including the following:

In order to comply with federal, state or local laws, including compliance with a court order, subpoena, regulatory inquiry or summons.

In order to cooperate with law enforcement agency investigations.

For emergency access if a natural person is at risk or danger of death or serious injury.

Exercising/defending legal claims, including in response to civil litigation discovery requests.

With respect to deidentified or aggregate consumer information.

With respect to conduct that takes place wholly outside of California.

Where compliance with the CCPA/CPRA would violate a state evidentiary privilege.

We are not obligated under the CCPA/CPRA to provide or delete deidentified information in response to a verifiable consumer request, or to re-identify individual data to verify a consumer request.

Personal Information That We May Collect

You do not need to provide any personal information to visit public sections of the Site.

To evaluate the Site and improve our service to you, our computers may automatically collect and record usage data, such as IP addresses, domain servers, browser type, access time, cookie information, information regarding what website you were referred from, and what pages you visit on our Site. See “Use of Cookies,” below, for more information.

If you submit information via our Site, we may ask for information such as your name, email address, postal address, zip code, telephone number, gender, personal interests, comments, and preferences relating to our products and services. We maintain personal information that you voluntarily provide us indefinitely in order to maintain our relationship with you, as described below in “How We Use and Disclose Your Information.”

How We Use and Disclose Your Information

We may use personal information you provide on an aggregated basis to do such things as operate our Site, enhance our Site, and to better understand the profile of our online audience. We may also use this data, both in aggregate form and as provided by you, to enhance your experience on our Site by displaying content and marketing messages that we believe will be of interest to you. In some cases we use your personal information to contact you or to provide information to you, such as to send you newsletters, coupons, or recipes, but only if requested. Users may elect to stop receiving such messages at their discretion. If you no longer wish to receive periodic email updates from Ready Pac, please send an email to us at webmaster@readypac.com with “Unsubscribe” in the subject line. You may also follow the unsubscribe instructions included in each promotional email.

If you submit a recipe, comment or feedback to us, you acknowledge that the contents of your submission do not constitute your personal information and that you are authorized to provide such submission (e.g., the submission is not subject to any copyright or other intellectual property protection). You agree that if we post or otherwise use your submission, we are authorized to do so and we may disclose your name so that we can credit you with submitting the submission, but we are under no obligation to do so.

Personal Information Disclosed Within the Last Twelve (12) Months We have disclosed the following categories of personal information for a business purposes from consumers within the last twelve (12) months to the following categories of third parties:

Information Sharing and Disclosure

We do not sell or share your personal information with nonaffiliated companies or individuals, except with your permission, or under the following circumstances:

We may provide the information to service providers (such as Internet or email providers) who we engage to work on our behalf under confidentiality agreements that restrict them from using your personal information for any purposes not related to our engagement. These companies may use your personal information for our business purposes, such as to help us communicate with you about offers or to administer the Site. These companies do not have any independent right to share this information and are required to provide the same levels of security and privacy for your personal information as Ready Pac, and to comply with applicable regulations.

In response to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or the interests of our customers or users of the Site or to defend against legal claims.

When we believe it is necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of Ready Pac or any member of our group, our customers, or others, or violations of the any terms of use specified on the Site, or as otherwise required by law. This

includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

We may transfer, sell, or assign to third parties information about you and your relationship with us including, without limitation, personal information that you provide, in the event of a sale, merger, consolidation, change in control, transfer of substantial assets, reorganization, or liquidation. If Ready Pac or any company of our group is acquired by a third party, in such case personal information about consumers may be one of the transferred assets.

We may share non-personal, non-individual (anonymous) statistics or demographic information in aggregate form with our marketing partners, advertisers or other third-parties for research purposes.

Use of Cookies

When you visit the Site, we may store or retrieve information on your browser and device using cookies and similar technologies, which may be set by us or other companies who provide services to us in connection with the Site. Cookies and the information they collect might relate to you, your preferences or your device, and are used to make the Site work as you expect it to, store your preferences, help us understand how people use the Site, and provide a more personalized experience.

You can choose not to allow certain types of cookies via your browser settings, but it may impact your experience and some features on the Site. Your choice is specific to the device and browser you are using, and may be deleted when you clear the cookies on your device or browser.

Ready Pac uses cookies to track user activity on the Site in the following respects: User & Traffic acquisition.

Demographics (location & language).

Engagement (Page view, Session, 1st visit, scroll, clicks, user engagement).

Browsers.

Devices. Some cookies are session-specific and expire after the user closes the browser. Other cookies may be persistent and will remain until a set expiration date expires or if a user clears their device cache.

We only set and access our own first-party cookies in order to operate the Site for you, and we do not access any third party cookies. We do not offer any advertising on the Site, including personalized, contextual or targeted advertising.

We use Google Analytics to track IP addresses, which include geographical location. This data is collected by Google Analytics and we can access Google Analytics reports, which provides aggregated data. But we do not receive or collect individualized personal data (including IP addresses) from Google Analytics reporting. Do Not Track” Signals We do not respond to, or process, “Do Not Track” (DNT) or other signals or mechanisms in Internet browsers that provide consumers the ability to exercise choice regarding the collection of personally identifiable information about an individual consumer’s online activities over time and across third party websites or online services. DNT is a feature offered by some browsers which, when enabled, sends a signal to websites to request that your browsing is not tracked, such as by third party ad networks, social networks and analytic companies. We do not currently take actions to respond to DNT signals because a uniform technological standard has not yet been developed. The Site may contain hyperlinks to websites of third parties. This Privacy Statement does not apply to such third party content or websites. If individuals decide to follow such links, they must be aware that Ready Pac does not take any responsibility for the third party content or compliance of the third party website with data privacy laws. Individuals are encouraged to make themselves aware of applicable privacy policies before they submit personal information to third party websites.

Privacy of Children Under 13

Ready Pac does not knowingly collect, use, sell or share personal information from children actually known to be under the age of 13. We will not knowingly contact children under age 13 without a parent’s permission. If you are a parent or guardian of a child under the age of 13 and believe he or she has disclosed personal information to us please contact us at webmaster@readypac.com. A verified parent or guardian of a child under the age of 13 may review and request deletion of such child’s personally identifiable information. If Ready Pac is made aware that it has collected personal information from a minor in a manner that is inconsistent with applicable laws, Ready Pac will delete this information as soon as possible.

We do not sell or share the personal information of any individuals (except as set forth above in “Information Sharing and Disclosure”) and, therefore, necessarily do not sell or share the information of children of any age.

Notice of Financial Incentive

From time to time, we may offer financial incentives to promote our products and services. These financial incentives may include discounts, coupons, and special offers when you sign up for our email list, or participate in a marketing promotion.

Sometimes, we may ask you to provide personal information in connection with these promotions. For example, when voluntarily answering a survey (such as when you invoke a QR code on a Ready Pac product), you may have to provide your name, email address, gender and age group in order to obtain a Ready Pac coupon.

Participation in any financial incentive program is optional and you may withdraw from the program at any time by emailing webmaster@readypac.com. To stop receiving Ready Pac coupons or discounts in your email, you may unsubscribe from our emails by clicking the “unsubscribe” button at the bottom of any such email.

The value of any financial incentive we offer is reasonably related to the value of any personal information you provide to us. We estimate the value of your personal information by considering, without limitation, the expenses we incur from collecting your personal information and/or providing the financial incentive to you, the revenue generated by your use of the financial incentive, and any improvements we can make to our products and services based on aggregating information obtained through the financial incentive program.

Please note that we may provide additional terms that apply to a particular financial incentive. If applicable, those terms will be presented to you at sign up.

Additional Information for California Employees and Job Applicants

If you are a California resident and are a current or former Ready Pac employee, or a job applicant, please refer to the documents we provide to you and other Ready Pac policies for information about our privacy practices related to workforce members (i.e., employees, contractors or job applicants).

If you submit unsolicited applications or a resume directly to us via mail, email or personal delivery, we may advise you to apply for any open positions through [job site, e.g., indeed.com], and we may delete your submissions. We reserve the right to maintain applications and resumes submitted in such manner for a period of up to 180 days.

Revisions to this Privacy Statement

Ready Pac reserves the right to change or update this Privacy Statement at any time. The applicable version of this Privacy Statement is available on the Site. If such change to the Privacy Statement requires your consent, you will have a choice to consent as to whether or not Ready Pac may use your personal information in the revised manner.

Data Security of your Personal Information and Communications With Ready Pac

Ready Pac maintains appropriate physical, technical and organizational security measures in order to protect your personal information from loss, misuse, unauthorized access, disclosure or alteration, in accordance with applicable data protection and privacy laws, and industry standards. Due to the open transmission nature of information via the Internet (including but not limited to email), data in transit is not completely secure. Although we take reasonable measures to secure your personal information, we cannot represent, warrant or guarantee the security of your data transmitted to the Site or communications between you and us or that personal information stored on our servers, will be free from unauthorized access by third parties, loss, misuse, or alterations. READY PAC DISCLAIMS ANY AND ALL LIABILITY FOR UNAUTHORIZED ACCESS OR USE, OR COMPROMISE OF YOUR PERSONAL INFORMATION SUBMITTED THROUGH THE SITE. USERS ARE HEREBY ADVISED THAT THEY SUBMIT SUCH PERSONAL INFORMATION AT THEIR OWN RISK.
